Molgas is a company dedicated to the commercialisation and supply of natural gas, duly registered as a natural gas commercialisation company in the corresponding Register of the Directorate General for Energy Policy and Mines, of the Ministry of Economy, with identification number S2-021. 

If you access and/or use the Website, you become a user and you accept this Legal Disclaimer.

2.- PURPOSE 

This Legal Disclaimer regulates the access and use of the Website, notwithstanding the fact that Molgas reserves the right, at its sole discretion, to change, modify, add or remove parts of it at any time. In this case, we will keep you informed of the changes introduced.  

However, access to certain content and the use of certain services may be subject to certain special conditions, which will in any case be clearly displayed and must be expressly accepted by users. These particular conditions may replace, complete or, where appropriate, modify those established in this legal disclaimer.  

For the purposes of the interpretation of this Legal Disclaimer, it is understood that a person becomes a user at the moment that he/she accepts this Legal Disclaimer, the Privacy Policy and the Cookies set out in the Website.  

The User guarantees that they have the legal capacity, based on their age, to read and understand the provisions of this legal disclaimer and will be entirely responsible for this declaration, as well as for accessing and correctly using the Website.  

3.- INTELLECTUAL AN INDUSTRIAL PROPERTY 

Molgas is responsible for and has the corresponding licenses on the exploitation rights of industrial intellectual property necessary to operate in the Website, e.g. texts, photographs, illustrations, logos, trademarks, designs or any other information or content and the services available through this. 

Under no circumstances will it be understood that access to and use of the Website by the User implies a waiver, transmission, licence or total or partial transfer of said rights by Molgas. The User has the right to use the contents and/or services of the Website strictly for the purpose of enjoying the services provided in accordance with this Legal Disclaimer. 

All intellectual and industrial property rights over the contents and/or services of the Website are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of the contents included in the Website, for any purpose, without the prior, express and written authorisation of Molgas.  

The services offered, or any information made available through the Website may not be used for commercial or advertising purposes without prior authorisation from Molgas.  

In any case and with regard to all the above, the User agrees not to use the Website for illegal or prohibited purposes.

 4.- PERSONAL DATA PROTECTION POLICY 

In accordance with the provisions of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, “LOPDGDD”), all personal data collected during the use of the Website will be processed in accordance with the provisions of the Privacy Policy, which all Users must expressly accept. You can also obtain more information on the use of cookies and the information collected through them through the Cookies Policy. 

 5.- RULES FOR THE USE OF THE WEBSITE 

Access to or use of the Website for illegal or unauthorised purposes, whether for profit or not, is not permitted and, therefore, the consequences will be the sole responsibility of the User. In particular, and without the following list being restrictive in nature, Users are prohibited from: 

• Use the Website for the transmission, installation or publication of any virus, malicious code, or other harmful programmes or files;
• Use the Website in any manner that may cause damage, interruptions, inefficiencies or defects in the Website operation or in the computer equipment of any third party.
• Use the Website in an illegal manner, against good faith, morality and public order;
• Registering on the Website under a false identity, impersonating a third party or using a profile or taking any other action that may mislead other Users as to the User’s Identity;
• Carrying out any action that causes a disproportionate or unnecessary saturation in the infrastructure of the Website or in Molgas’ systems and networks, as well as on the systems and networks connected to the Website. 
• Preventing the normal development of the interconnection, contact, or any other activity of the Website, or any of its functionalities, either by altering or attempting to alter, illegally or in any other way, the access, participation or operation of the same, or by falsifying the result of the same and/or using fraudulent methods, by means of any procedure and/or through any practice that violates or infringes this Legal Disclaimer. 

In addition, it should be mentioned that the use of the website is for information and contact purposes only. Entry to and display the Website is free, free of charge and does not require prior subscription or registration. However, access to certain services may be subject to specific conditions of use, which in any case may be consulted by the user before contracting them, as in the case of the General Conditions of Use of the Molgas Card. 

6.- EXCLUSION OF LIABILITY 

The use of this website is at the sole responsibility of the User. The User understands and accepts that the website has been created and developed in good faith by Molgas and is offered to users in its current state. 

Molgas reserves the right to temporarily stop access to the website without prior notice, as well as the right to provide or cancel services and products at any time, trying to inform users beforehand when circumstances allow. 

Molgas is not responsible for any damage or harm caused to the user as a result of the lack access to the website or its lack of updating, or as a result of the lack of suitability to meet Users’ specific needs, nor is it responsible for those access problems and/or incorrect access by Users to the Website due to the use of a computer system (software and hardware) not suitable for it, nor for the use of certain browsers, Internet access restrictions, devices, operating systems, etc., and/or any other circumstances that may affect access to the Website by Users.

Molgas is not responsible for damages of any nature that may be caused to the user of this website by the existence of viruses or harmful programs, or by the use os this website in contravention of the law or good faith. Therefore, Molgas neither controls nor guarantees the absence of viruses or other elements in the contents of the website that may cause alterations in the user’s computer system (software and hardware), in their devices or in the electronic documents and files stored in their computer systems.  

Molgas reserves the right to object to and/or remove, from the time of its effective knowledge, any contact which does not comply with this Disclaimer, the Privacy Policy, the Cookie Policy and/or any other document which regulates any aspect of the website signed between Users and Molgas, and to deny or cancel access to the website to any person or entity at the discretion of Molgas. Therefore, Users may notify Molgas of any violation of the Legal Disclaimer, its Privacy an Cookie Policy, its contents and/or any other document regulating aspects of the website that is signed between Users and Molgas at the following e-mail address: rgpd.mlg@molgas.es. 

7.- OTHER TERMS AND CONDITIONS 

The terms and conditions of this Legal Disclaimer constitute the entire agreement between Molgas and the User in regard to the subject matter of this document, and may only be modified by a written amendment signed by an authorized person of Molgas or by the publication of a revised version by Molgas. This is without notwithstanding the provisions of the Privacy Policy and the Cookie Policy, as well as any document regulating aspects of the Website signed between Users and Molgas. 

If any clause of the conditions of this Legal Disclaimer is declared totally or partially null of ineffective, it will only affect the provision or part of the same that is null or ineffective, with the rest of the terms of the Legal Disclaimer remaining in force in all other respects and the provisions or part of the same that is affected being deemed not to have been included, unless, as it essential to this Legal Disclaimer, it should affect them in an integral manner. 

Users shall be subject to the terms and conditions of the Legal Disclaimer in force at all times and while using the website, notwithstanding the provision of the General Conditions of Use of the Molgas card and/or when the Law or a competent body provides otherwise. 

The website and its contents are offered in Spanish, French, Portuguese, Italian and English, so in the event of any conflict in the implementation or interpretation of this Legal Disclaimer, the Privacy and Cookie Policy and/or General Conditions of Use of the MOLGAS Card, the Spanish version will always prevail over any other. 

8.- APPLICABLE RULES AND JURISDICTION  

The conditions set out above are governed by Spanish law. Molgas and the User, expressly waiving their right to any other jurisdiction that may correspond to them by law, expressly submit to the jurisdiction of the courts of Madrid in the event of any disputes arising in relation to this Website.  

Notwithstanding the foregoing, if the User is considered a consumer, he/she may exercise his/her rights as such in relation to the Legal Disclaimer, the Privacy and Cookies Policy and/or the General Conditions of Use of the Molgas Card, both in Spain an in his/her Member State of residence in the European Union.
